Students will be divided into groups of eight (8). The instructor will randomly assign a case from one of the topic areas discussed in class:

Moot Instructions:
Two (2) groups of eight (8) will present each class.
Each group of eight (8) will be divided into two groups of four (4).
One group of four (4) will agree with the court’s decision and the other will disagree with the decision. Each member of the group will be given one of the following perspectives:
Impact on Society (e.g. public perception, special interest groups, government reasons for legislation)•

Legal implications – what does this mean for law enforcement, the courts, the judicial system and/or the government?•
Charter arguments (two students will be assigned this perspective. They will submit individual papers). What are the Charter arguments? Look at the “tests” that have been developed and the reasons for these tests and the court’s decision.•
Presentation
One person from the team of eight (8) will provide a brief statement of the facts of the case. This overview does not contain bias – it must be the facts, clearly stated.
Prepare an overview statement of your position with at least one clear point that supports your argument. Each person can speak for no more than 2 minutes. Do NOT read your individual paper.
The Moot presentation is an oral argument, be prepared to argue your point persuasively.
All members of the group must have a prepared statement and must speak.
After both sides have presented their argument, they will challenge the opposite side’s position
You will also need to be prepared to answer and ask questions. Therefore it is important that you listen to the presentation of other students.

*During the time the other side is presenting, you should be determining questions to ask.
Questions and Challenges: (20- 30 minutes)
After both sides have presented each side will have the opportunity to ask the other side questions, or to challenge a point that was made. The class (and instructor) will also have the opportunity to ask questions.

Instructions for your written argument:
Your paper will be the written argument supporting your position. The introduction of your paper must clearly state your argument/position.
The body of your paper should layout your position and provide reasons for your decision.
Your paper should also respond to arguments that you expect from your opponents.
You must include proper citations.
The background of case is not required and will be deducted from the overall word count of your paper.
